    This Privacy Policy describes how Refined Advertising (operating as "Refined Advertising," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit refinedadvertising.ca (the "Website"), contact us, submit a form, or otherwise use our services (collectively, the "Services").

    Refined Advertising is a marketing systems agency based in Ontario, Canada. We build and operate automated customer-communication systems (including SMS/text automation, automated review requests, missed-call text-back, lead-response messaging, unified inbox management, Google Business Profile optimization, website builds, and related AI-powered tools) for our business clients.

    2. Information We Collect

    a) Information you provide directly

    • Contact and identity information: name, email address, phone/mobile number, business name, and job role.
    • Form submissions: any information you enter into a form on our Website or on a landing page we operate (including free-quote, contact, booking, and lead forms).
    • Communications: the content of messages, emails, texts, call notes, and other correspondence you exchange with us.
    • Billing information: where you become a paying client, billing contact details and payment information (payment card data is processed by our third-party payment processor and is not stored by us).

    b) Information collected automatically

    When you use the Website, we may automatically collect:

    • IP address, browser type, device information, operating system;
    • pages visited, referring URLs, time spent, and other usage data;
    • information collected through cookies, pixels, and similar technologies (see Section 7).

    c) Information from third parties

    We may receive information about you from advertising and analytics platforms (e.g., Meta, Google), lead-generation forms, and our service providers, consistent with those platforms' terms and your consent to them.

    3. How We Use Your Information

    We use personal information to:

    • respond to your inquiries and provide requested information or quotes;
    • send you text messages and emails you have consented to receive (see Sections 4 and 5);
    • provide, operate, maintain, and improve the Services;
    • schedule and confirm appointments and calls;
    • process payments and manage our client relationships;
    • personalize and improve the Website and our marketing;
    • comply with legal obligations and enforce our Terms & Conditions;
    • protect against fraud, security incidents, and misuse.

    We only use personal information for the purposes for which it was collected, or for a consistent purpose, unless we obtain your further consent.

    4. SMS / Text Messaging Program and Consent

    By submitting your mobile number through a form on our Website or landing pages, or by otherwise providing it to us and agreeing to receive text messages, you expressly consent to receive SMS/text messages from Refined Advertising at the number provided.

    • Program description: We send text messages relating to your inquiry, appointment reminders and confirmations, follow-ups, account and service updates, and (where you have consented) promotional offers.
    • Message frequency: Message frequency varies based on your interaction with us.
    • Costs: Message and data rates may apply, depending on your mobile carrier and plan.
    • Opt out: You can opt out at any time by replying STOP to any text message. You will receive a confirmation and we will stop sending you marketing/automated texts.
    • Help: Reply HELP to any message for assistance, or contact us using the details in Section 1.
    • Carriers: Mobile carriers are not liable for delayed or undelivered messages.

    Consent is not a condition of purchase. You are not required to consent to receive marketing texts as a condition of purchasing any goods or services.

    Mobile opt-in data is never shared or sold. No mobile information (including your phone number and your consent to receive text messages) will be shared with third parties or affiliates for their own marketing or promotional purposes. This category of information is excluded from any information sharing described elsewhere in this Policy. We only share this information with the service providers that operate our messaging platform strictly to deliver the messages you have requested (see Section 8).

    5. Email and CASL Consent

    When you provide your email address and consent, we may send you commercial electronic messages (CEMs) in compliance with CASL. Every marketing email we send includes:

    • clear identification of who we are and how to contact us; and
    • a working unsubscribe mechanism.

    You can withdraw your consent to receive marketing emails at any time by using the unsubscribe link in any email or by contacting us directly. We may still send you non-marketing (transactional or service) messages where permitted by law.

    6. Legal Basis / Consent

    We collect, use, and disclose personal information with your knowledge and consent, except where permitted or required by law. Consent may be express (e.g., checking a consent box, submitting a form, or replying to a message) or implied (e.g., where you have an existing business relationship with us, as defined under PIPEDA and CASL). You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us. Withdrawing consent may limit our ability to provide certain Services.

    7. Cookies and Tracking Technologies

    We use cookies, web beacons, tracking pixels (including the Meta Pixel and Google tags), and analytics tools (such as Google Analytics) to operate the Website, understand usage, and measure and improve our advertising. You can control cookies through your browser settings and opt out of certain advertising tracking through the platforms' own tools (e.g., Google Ads Settings, Meta ad preferences). Disabling cookies may affect Website functionality.

    8. How We Share and Disclose Information

    We do not sell your personal information. We share personal information only as follows:

    • Service providers: We use trusted third-party providers to deliver the Services, including our marketing-automation and messaging platform and its messaging partners, email delivery providers, hosting providers, analytics providers, and payment processors. These providers process personal information on our behalf and are bound to protect it.
    • Advertising and analytics platforms: e.g., Google and Meta, consistent with Section 7.
    • Legal and safety reasons: where required by law, regulation, legal process, or to protect our rights, safety, or property, or that of others.
    • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.

    Exception: As stated in Section 4, text-messaging opt-in data and consent are never shared with third parties for their marketing purposes.

    Some of our service providers are located in the United States or other countries. Where personal information is transferred outside Canada, it may be subject to the laws of those jurisdictions, including lawful access by courts and government authorities. We take reasonable steps to ensure it is protected consistently with this Policy.

    9. Information We Process on Behalf of Our Clients

    When we provide Services to a business client, we may process personal information about that client's own customers and leads (for example, running a client's SMS follow-up or review-request campaign). In these cases, we act as a service provider processing information on the client's behalf and under the client's instructions. Our client is responsible for obtaining all necessary consents from their customers and for complying with CASL, PIPEDA, and applicable messaging laws. If you are a customer of one of our clients and have questions about how your information is used, please contact that business directly. We will refer such requests to the relevant client where appropriate.

    10. Data Storage, Location, and Security

    We store personal information on secure servers operated by us and our service providers, which may be located in Canada, the United States, or other jurisdictions. We use reasonable physical, technical, and administrative safeguards designed to protect personal information against loss, theft, and unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

    14. Children's Privacy

    The Website and Services are intended for businesses and individuals who are the age of majority in their province or territory. We do not knowingly collect personal information from children. If you believe we have collected information from a minor, please contact us and we will delete it.
